Purpose

These terms govern access to Mahi Binebine’s site and the use of its pages.

The site informs you about the works, the books, the exhibitions and the news. On its own it is not an offer of sale, an order form or a contract of acquisition.

Acceptance

Visiting the site means accepting these terms and the laws that apply. If you do not accept them, you should not use the site.

The date under the title is that of the version in force. It may be replaced. Use after an update means you have read the new version.

Access

Access to the public pages is free of charge. It assumes an internet connection, whose cost and security remain yours.

The publisher may suspend access, change a page or remove a content, in particular for an update, maintenance, an error, or respect for a third party’s rights. Continuity of service is not guaranteed.

Administration

The area used to publish is reserved for people with authorised access. There is no public registration.

  • credentials are personal
  • they are not lent and not shared
  • any use made with those credentials is treated as the holder’s
  • access may be withdrawn at any time

Use of the site

You may read the pages, watch the home film and write through the Contact page. You agree not to:

  • disrupt the site or try to reach it without authorisation
  • extract texts, images or the catalogue on a massive scale
  • reproduce a work, a photograph or a text beyond private viewing
  • suggest a partnership, a mandate or a representation that does not exist
  • send, in a message, something unlawful, abusive, or unrelated to a real request
  • use the site to send bulk messages or to harvest addresses

Works and texts

The works, photographs, texts and the composition of the site are protected. Unless stated otherwise, they remain the property of Mahi Binebine or their rights holders.

Viewing on screen, for private use, is allowed. Any other use — public, editorial, commercial, or the making of a copy meant to circulate — requires written agreement from the artist or the holder named.

A short quotation remains possible if it names the artist and the source, within the limits of the law. Trademarks, typefaces and third-party services remain their owners’ property.

Third-party services

Once you leave the site, you come under the terms of the service you open:

  • Instagram, X and Facebook, for the public accounts

Those services may set their own tracers and change their pages. Mahi Binebine does not control how they work.

Published information

Notes, exhibition dates and news are written with care. They may be corrected. A date on screen is not a commitment until it has been confirmed in an exchange.

For a precision about a work, a book or an exhibition, the Contact page is the right channel. The site does not replace a certificate, an invoice or a contract.

Responsibility

The publisher is not responsible for:

  • interruptions caused by the host, the network, the video player or an event of force majeure
  • the content of third-party sites a link leads to
  • the use you make of images and texts beyond private viewing
  • an indirect loss tied to being unable to reach the site

Nothing in these terms sets aside a responsibility that the law does not allow to be set aside.

Changes

These terms may be changed to follow the site, a third-party service or the law. The version on screen, with its date, is the one that applies. A substantial change is visible because that date is updated.

Applicable law

The site is published from Marrakech. Moroccan law applies, without taking from a person the mandatory protections of their country of residence when those protections are meant to apply.

A difficulty is first handled by an exchange through the Contact page, before any formal claim.
